We encourage you to use the AppFlight service, but we require you to read and adhere to our Terms. Please take a minute to review the following information. Thank you!
Introduction.
The website is owned and operated by App Genie, LLC (herein referred to as “AppFlight”). The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation to, AppFlight’s Privacy Policy) and procedures that may be published from time to time by AppFlight (collectively, the “Agreement”).
By using, accessing, or downloading any AppFlight mobile applications and/or by accessing AppFlight.com you are agreeing to be bound by the following terms and conditions of the Agreement. AppFlight reserves the right to update and change the Agreement from time to time without notice. Violation of any of the terms below will result in the termination of your account.
Legal Hoopla
Disclaimer of Warranties.
AppFlight is provided “as is”. AppFlight and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither AppFlight nor its suppliers and licensors, makes any warranty that AppFlight will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, AppFlight at your own discretion and risk.
Limitation of Liability.
In no event will AppFlight, or its suppliers or licensors, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement or substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to AppFlight under this agreement during the twelve (12) month period prior to the cause of action. AppFlight shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.
Indemnification.
You agree to indemnify and hold harmless AppFlight, its contractors, and its licensors, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of AppFlight, including but not limited to your violation of this Agreement.
Intellectual Property.
This Agreement does not transfer any third party intellectual property, and all right, title and interest in and to such property will remain (as between the parties) solely with AppFlight.
Governing Law.
This agreement shall be governed by the law of New Jersey, USA.
Content within Applications.
We have not reviewed, and cannot review, all of the material, made available in AppFlight applications. AppFlight is not responsible for their contents or their use.
Copyright Infringement.
If you believe that material located on or linked to by an AppFlight application violates your copyright, you are encouraged to notify AppFlight. AppFlight will respond to all such notices, including as required or appropriate by removing the infringing material or disabling all links to the infringing material.
Account Hoopla
You agree to use AppFlight at your own risk.
You are responsible for your account, including but not limited to, the security of your personal login credentials.
You must be 13 years or older to use AppFlight.
You are responsible for all activity on your account.
You may not use AppFlight for any illegal purpose.
You may not use any material in your app that you do not own.
AppFlight is here to make sure your app gets into the App Store. If your app gets removed from the App Store, we are not liable and no refund will be given. Refunds before submissions will be complete within 30 days of cancellation.
You are responsible for marketing and promotion of your app, and ultimately it's success.
AppFlight is responsible for trying to get your application into each respective app store. Appflight is responsible for making sure that all development and function guidelines are met and satisfied for approval. You, not Appflight, are repsonible if your app is not approved because of the content that as been added. If your app fails to be approved because of functional or development causes, Appflight will issue you a refund for the amount respective to that platform. Depending on the time of the refund, a service charge of no more than 3% may or may not be impossed by our credit processer, this fee will not be from Appflight.
AppFlight has the right to refuse your account, as it sees fit.
